一、租赁物件、租期、租价及付款方式 / Lease, Leasing Term, Rent, and Settlement

1. 甲方同意将型号为________________________的车辆壹辆出租给乙方使用，该车颜色为________________________，车牌号为浙________________________。
Party A agrees to lease one vehicle (Model: ________________________, Color: ________________________, License Plate No.: Zhejiang ________________________) to Party B for use.

2. 租期从2022年9月10日至2023年3月9日，月租金为3000元（人民币），日租金约为100元（人民币）。若因车辆自身故障导致无法使用，乙方可随时解除本合同，租金按实际使用天数结算；乙方若需提前解约，需提前2周书面通知甲方，租金同样按实际使用天数结算。
The lease term is from September 10, 2022, to March 9, 2023, with a monthly rent of 3,000 RMB (daily rent: approximately 100 RMB). If the vehicle is unavailable due to its own faults, Party B may terminate this agreement at any time, and the rent shall be calculated based on the actual number of days used. If Party B needs to terminate the agreement in advance, it shall give Party A a 2-week written notice, and the rent shall also be calculated based on the actual number of days used.

3. 乙方租用车辆时，需向甲方支付3000元（人民币）作为履约保证金/押金。租赁期满，若乙方无交通违章记录且车辆无因乙方使用造成的损坏，甲方将于还车后20个工作日内不计利息退还全部保证金/押金。
Party B shall pay a deposit of 3,000 RMB to Party A upon leasing the vehicle. Upon expiration of the lease term, if Party B has no traffic violation records and the vehicle has no damage caused by Party B’s use, Party A shall refund the full deposit without interest within 20 working days after the vehicle is returned.

4. 租金采取按月预付方式，乙方需在每月租赁起始日前支付当月租金。
The rent shall be paid monthly in advance, and Party B shall pay the monthly rent before the start of each lease month.

二、甲方的责任和义务 / Party A’s Rights and Responsibilities

1. 甲方保证出租车辆在交付时性能良好、设备齐全，且随车配备有效的车辆行驶证等证件。
Party A guarantees that the leased vehicle is in good condition, fully equipped, and accompanied by valid documents (such as the Vehicle Driving Permit) when delivered.

2. 甲方负责车辆每季度5000公里以内的定期保养（超出该里程的保养费用由乙方承担）及年度检验；因乙方使用不当或第三方造成的车辆维修，费用由乙方或第三方承担，甲方不负责。
Party A shall be responsible for the regular maintenance of the vehicle within 5,000 kilometers per quarter (maintenance costs exceeding this mileage shall be borne by Party B) and the annual vehicle inspection. Party A shall not be responsible for vehicle repairs caused by improper use by Party B or third parties, and the repair costs shall be borne by Party B or the third party.

3. 甲方指定汽车修理厂对出租车辆进行维修，因乙方交通事故或人为原因造成的维修费用，由乙方承担。
Party A shall designate an auto repair shop for the maintenance of the leased vehicle. Repair costs caused by traffic accidents or man-made reasons of Party B shall be borne by Party B.

4. 甲方为出租车辆投保车辆损失险、第三者责任险及车上人员责任险（司机），并协助乙方处理交通事故，按保险公司规定办理理赔手续。
Party A shall insure the leased vehicle against vehicle damage, third-party liability, and driver’s personal injury, and assist Party B in handling traffic accidents and going through insurance claim procedures in accordance with the insurance company’s regulations.

5. 因车辆自身故障需维修的，维修期间的租金由甲方免除（按实际维修天数计算）。
If the vehicle needs repair due to its own faults, Party A shall exempt the rent during the repair period (calculated based on the actual number of repair days).

三、乙方的责任和义务 / Party B’s Rights and Responsibilities

1. 乙方及乙方授权的驾驶员必须持有中华人民共和国公安交通管理部门核发的有效机动车驾驶证，且驾龄满1年，并严格遵守中国交通法律法规；因违反上述规定造成的一切后果，由乙方承担。
Party B and its authorized drivers must hold valid motor vehicle driving licenses issued by the traffic administration department of the People’s Republic of China with a driving experience of more than 1 year, and strictly abide by China’s traffic laws and regulations. Party B shall bear all consequences caused by violating the above provisions.

2. 乙方不得将租赁车辆转租、转借、变卖、抵押，也不得对车辆主张本合同约定以外的任何权利。
Party B shall not sublet, relet, sell, mortgage the leased vehicle, nor claim any rights other than those stipulated in this agreement with respect to the vehicle.

3. 严禁使用租赁车辆从事违法活动、参加竞赛或测试，严禁用于营利性营运，严禁运输易燃、易爆、易腐蚀等危害车辆安全的物品。
It is prohibited to use the leased vehicle for illegal activities, competitions or tests, profitable operations, or transporting flammable, explosive, corrosive and other items that endanger vehicle safety.

4. 租赁车辆发生机件故障或事故损坏时，乙方必须到甲方指定的修理厂维修；因乙方人为原因造成的机件故障，维修费用由乙方自行承担。
When the leased vehicle has mechanical failures or accident damage, Party B must have the vehicle repaired at the repair shop designated by Party A. Repair costs for mechanical failures caused by Party B’s man-made reasons shall be borne by Party B.

四、意外交通事故处理及保险 / Traffic Accident and Insurance

1. 乙方发生交通事故（含非道路交通事故），应立即向交通管理部门报案并保护现场（符合“快处快撤”条件的除外），同时立即通知甲方；事故处理完毕后，乙方需在5日内将交通管理部门出具的事故认定书及其他理赔材料交付甲方，由甲方办理保险理赔。若乙方逾期未提供上述材料导致无法理赔，事故造成的全部损失由乙方承担。未经甲方同意，乙方不得擅自处理事故或安排维修。
In case of a traffic accident (including non-road accidents), Party B shall immediately report to the traffic administration department, protect the scene (except for cases meeting the "quick handling and removal" conditions), and notify Party A immediately. After the accident is handled, Party B shall deliver the accident confirmation certificate issued by the traffic administration department and other claim materials to Party A within 5 days, and Party A shall handle the insurance claim. If Party B fails to provide the above materials within the time limit, resulting in failure to settle the claim, Party B shall bear all losses caused by the accident. Without Party A’s consent, Party B shall not handle the accident or arrange repairs without authorization.

2. 因乙方或其授权驾驶员驾驶导致的交通事故，根据保险条款及交通管理部门的责任认定，扣除第三者强制险赔偿部分后，剩余未被保险覆盖的损失（如第三方财产损失、医疗费用等），由乙方承担。
For traffic accidents caused by Party B or its authorized drivers, after deducting the compensation from the compulsory third-party liability insurance in accordance with the insurance clauses and the liability determination of the traffic administration department, Party B shall bear the remaining losses not covered by the insurance (such as third-party property losses, medical expenses, etc.).

3. 租赁车辆在非正式道路发生单车轻微事故时，乙方应立即向交通管理部门或保险公司报案，等待保险公司现场勘查；甲方代为办理保险理赔，保险公司理赔不足部分由乙方承担。
In case of a minor single-vehicle accident on an informal road, Party B shall immediately report to the traffic administration department or the insurance company and wait for the insurance company’s on-site investigation. Party A shall handle the insurance claim on behalf of Party B, and Party B shall bear the part not covered by the insurance company’s compensation.

4. 租赁车辆因事故造成损失的，乙方应先行支付全部费用；甲方按保险公司规定办理理赔后，将理赔款足额退还乙方；保险公司不予理赔的部分，由乙方承担。
If the leased vehicle suffers losses due to an accident, Party B shall pay all expenses in advance. After Party A handles the insurance claim in accordance with the insurance company’s regulations, it shall refund the full claim amount to Party B. Party B shall bear the part not compensated by the insurance company.

5. 若乙方因严重交通违法或交通事故导致车辆保险费率上浮，上浮部分的保险费用由乙方承担（按保险公司标准执行）。
If Party B causes an increase in the vehicle insurance rate due to serious traffic violations or traffic accidents, Party B shall bear the increased insurance premium (in accordance with the insurance company’s standards).

6. 因乙方授权驾驶员造成事故导致车辆停驶或维修的，甲方不提供免费替换车辆，乙方需承担车辆停驶及维修期间的租金。
If the vehicle is out of service or under repair due to an accident caused by Party B’s authorized driver, Party A shall not provide a free replacement vehicle, and Party B shall bear the rent during the vehicle’s out-of-service and repair period.

7. 乙方必须严格遵守《道路交通安全法》及实施条例，确保行车安全。若发生交通违法、交通事故或被“电子警察”抓拍，乙方应主动接受公安交警部门处理并及时缴纳罚款；甲方有权从押金中扣除乙方未缴纳的罚款。乙方还车后20个工作日内，甲方退还押金余额（不计利息）。根据杭州市机动车第三者责任险费率浮动制度，乙方需承担因上述原因导致的车辆保险费上浮部分。若因乙方未处理交通违法导致车辆无法通过年检并被强制停驶，乙方需承担相关责任及费用。
Party B must strictly abide by the Road Traffic Safety Law and its implementation regulations to ensure driving safety. In case of traffic violations, traffic accidents or being captured by "electronic police", Party B shall take the initiative to accept the handling of the public security traffic police department and pay the fine in a timely manner; Party A has the right to deduct the unpaid fine from the deposit. Within 20 working days after Party B returns the vehicle, Party A shall refund the balance of the deposit (without interest). In accordance with the floating system of motor vehicle third-party liability insurance rates in Hangzhou, Party B shall bear the increased part of the vehicle insurance premium caused by the above reasons. If the vehicle fails to pass the annual inspection and is forced to stop due to Party B’s failure to handle traffic violations, Party B shall bear the relevant responsibilities and expenses.

六、其他 / Others

1. 本租赁车辆使用92号汽油，投保于________________________保险公司，英文客服电话为________________________，按________________________键可转接英文服务。
The leased vehicle uses No. 92 gasoline and is insured by ________________________ Insurance Company. The English customer service hotline is ________________________, and you can press the ________________________ key to connect to English service.

2. 乙方应配合甲方完成车辆规定里程的保养；若因乙方使用导致里程超出规定，超出部分的保养费用由乙方自行承担。
Party B shall cooperate with Party A to complete the maintenance of the vehicle within the specified mileage; if the mileage exceeds the specified limit due to Party B’s use, Party B shall bear the maintenance costs for the excess mileage.

3. 租赁期间，若乙方驾驶员因交通违法被“电子警察”抓拍，乙方应积极配合处理。
During the lease term, if Party B’s driver is captured by "electronic police" for traffic violations, Party B shall actively cooperate with the handling.

4. 本合同自双方签字（或盖章）之日起生效，一式两份，甲乙双方各执一份，具有同等法律效力。
This agreement shall take effect on the date of signature (or seal) by both parties, and is made in duplicate, with Party A and Party B each holding one copy, which have the same legal effect.
